Terms of Service

These terms cover your use of Benchmark Fantasy (“the game”), which is operated by RAD Dad Tech LLC (“we”, “us”). By signing in or playing, you agree to them. If you don't agree, please don't use the game.

The game

Benchmark Fantasy is a free fantasy game played with real stock prices. It is bragging rights only: there are no entry fees, no wagering, no prizes and no real trading of any security. If we ever offer a paid subscription, it will unlock features only, never affect results, and come with its own terms at purchase.

Not financial advice

Nothing in the game is investment, financial, tax or legal advice, and nothing here recommends buying or selling any security. Stock prices, news and statistics are for the game and may be delayed, incomplete or wrong. Scores are settled by the game's rules (see Rules), and we may correct a score or standing when we find an error in the data.

Your account

• You sign in with a Google account, and you are responsible for what happens on your account.
• You must be at least 13 years old, or older if your country requires it.
• If you are under 18, you need a parent or guardian's permission to use the game, and they agree to these terms on your behalf.
• Any contest or promotion we run may have its own eligibility rules, such as a minimum age of 18.
• One person per account, and don't pretend to be someone else.

Leagues and commissioners

A league's commissioner can invite players, hand a team to a new manager, moderate the league's chat and delete the league. Play fair with your league.

Conduct

Don't use the game to:

• harass, threaten or abuse anyone, or post hateful, sexual or illegal content;
• spam, scam or impersonate people;
• break, overload, scrape or get around the game's security or rules;
• break the law.

We may remove content and suspend or close accounts that break these rules.

Your content

You own what you post, such as chat messages and team names. You let us store it and show it within the game, including to the people in your leagues, so the game can work.

Our content

Benchmark Fantasy™, the Bench name, the logo, design and software are ours. Please don't copy them or use them to suggest we endorse something.

Other companies' marks

S&P 500® is a registered trademark of S&P Dow Jones Indices LLC. Benchmark Fantasy uses the index as a public benchmark to score against and is not affiliated with, sponsored or endorsed by S&P Dow Jones Indices. Company names, tickers and logos shown in the game belong to their owners and are used only to identify those companies; their appearance doesn't mean any company endorses or is affiliated with the game.

Availability and changes

We provide the game “as is” and “as available”, without warranties of any kind. We may change, pause or end features, or the game, at any time.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost profits or data, arising from your use of the game. Our total liability for any claim is limited to $50.

Ending your use

You can stop playing at any time and ask us to delete your account (see the Privacy Policy). We may suspend or end access for anyone who breaks these terms.

Changes to these terms

If these terms change, we will update this page and the date at the top. Continuing to play after a change means you accept the new terms.
